Terms of Use

The basics of using the Harvest Kernel Faculty Toolkit. Last updated June 2026 (beta). The institutional license terms below are newly added and are being finalized with legal counsel.

The service

The toolkit is a set of AI-assisted tools for higher-education instructors. Features may change as the product grows, and the service is provided on an "as is" basis without warranties.

Your content and outputs

You retain ownership of the content you submit and the outputs you generate. You are responsible for reviewing every output for accuracy and suitability before using it. AI-generated material can contain errors or omissions and is a starting point, not a final authority.

Data ownership

The institution and its users own the data they put into the toolkit, including course records, uploaded files, saved outputs, and any student data entered to use a tool. Harvest Kernel does not claim ownership of that data. We process it only to provide the service, under the institution's direction, and we return or delete it on request. We never sell it, use it for advertising, or use it to train AI models.

Institutional licenses

An institution can license the toolkit for a group of faculty. These terms are written to fit two cases without changing the core commitments:

  • Department or course pilot. A department, program, or individual instructors within an institution license a set number of seats. This is the lighter-weight starting point and does not require single sign-on or an administrator console.
  • Site or district license. A college, campus, or district licenses the toolkit more broadly. Larger deployments may later add institution-managed accounts, administrator roles, and single sign-on as those capabilities ship; until then, account and seat management is handled directly with Harvest Kernel.

For institutional licenses, the handling of student data is governed by a Data Processing Agreement and FERPA addendum. We offer our own template and are also willing to sign the institution's own paper. The institution remains the party responsible for education records under FERPA, and Harvest Kernel acts as a school official under the institution's direction and direct control.

Acceptable use

  • Use the toolkit for legitimate instructional purposes.
  • Do not attempt to disrupt, reverse engineer, or gain unauthorized access to the service.
  • Do not use the toolkit to store or process student data beyond what a task reasonably needs, and follow your institution's data-minimization guidance.
  • Do not upload content you do not have the right to use, or content that is unlawful.
  • Do not use the toolkit to harass, discriminate against, or harm any student or person.
  • Follow your institution's policies and applicable law, including those governing student data.

Accounts

Keep your login credentials secure. You are responsible for activity under your account.

Liability and indemnity

This section is being finalized with legal counsel. Limitation of liability, indemnification, and any data-breach-related terms for institutional licenses are set in the applicable order or Data Processing Agreement. Nothing here is a final statement of those terms until that agreement is signed.

Changes

We may update these terms and the service as the product evolves. Continued use after a change means you accept the update. For institutional licenses, material changes affecting student-data handling are communicated to the institution.
